New You Pilates – Client Terms & Conditions and Participation Agreement
Effective Date: 16 October 2026
Welcome to New You Pilates. Our goal is to provide a safe, supportive and professional Pilates experience for every client.
These Terms and Conditions apply to all clients participating in Pilates classes, private sessions, in-home Pilates, memberships and related services provided by New You Pilates.
By completing our client registration and accepting these Terms and Conditions, you agree to the following requirements.
1. Health Declaration and Medical Conditions
Your safety is important to us. Before participating in any Pilates activity, you agree to:
Provide accurate and complete information about relevant injuries, medical conditions, pregnancy, recent surgeries and physical limitations
Complete any required pre-exercise health screening questionnaire
Notify your instructor of any changes to your health or physical condition
Obtain medical clearance where reasonably requested or recommended
Inform your instructor immediately if you experience pain, dizziness, discomfort or unusual symptoms
You confirm that the health information you provide is accurate and complete to the best of your knowledge.
Where a client fails to disclose relevant information or disregards reasonable safety instructions, New You Pilates will not accept responsibility for injuries directly resulting from that failure to the extent permitted by law.
We reserve the right to modify, postpone or decline participation where reasonably necessary to protect your health or safety.
2. Understanding the Risks of Pilates
Pilates is a form of physical exercise involving controlled movement, stretching, strengthening, balance and resistance training.
Participation involves inherent physical risks, including:
Muscle soreness and fatigue
Muscle strains and joint injuries
Slips, trips and falls
Aggravation of existing injuries or medical conditions
Other injuries associated with physical activity
By participating, you acknowledge these risks and agree to exercise within your abilities, follow reasonable instructor directions and immediately communicate any discomfort.
You understand that individual results are not guaranteed.
3. Liability and Acknowledgement of Risk
New You Pilates takes reasonable steps to maintain a safe exercise environment, provide suitable equipment and deliver appropriate instruction.
By participating, you voluntarily acknowledge and accept the inherent risks associated with Pilates and physical exercise.
To the extent permitted by applicable law, New You Pilates excludes liability for personal injury, loss or damage arising from inherent exercise risks or a client's failure to follow reasonable safety instructions.
Where section 139A of the Competition and Consumer Act 2010 (Cth) or other applicable legislation permits an exclusion or limitation of liability for recreational services, that exclusion or limitation applies only to the extent legally permitted.
Nothing in this agreement excludes liability that cannot lawfully be excluded, including liability for reckless conduct where the law prohibits such exclusion.
Nothing in these Terms and Conditions excludes, restricts or modifies rights or remedies that cannot lawfully be excluded under Australian Consumer Law.
4. Class Bookings and Attendance
All classes and sessions must be booked using an approved booking method and are subject to availability.
Clients agree to:
Arrive on time and be prepared for their scheduled session
Follow studio rules and instructor directions
Wear suitable clothing and any required safety or hygiene accessories
Treat instructors and other participants respectfully
Late Arrivals: Clients arriving more than 10 minutes after a class begins may be refused participation for safety reasons. Where this occurs, the booking will be treated as a late cancellation or no-show, subject to applicable law.
5. Cancellation Policy and No-Shows
We understand that circumstances change. However, late cancellations can prevent other clients from booking available spaces.
The following cancellation policy applies:
24 hours or more notice: No cancellation fee applies
Less than 24 hours notice: The full booked class fee will be charged or one session deducted from a prepaid class package
Failure to attend: The full booked class fee will be charged or one session deducted from a prepaid class package
Late arrivals: Where entry is refused under Section 4, the same cancellation conditions apply
These charges are intended to reasonably protect the business against losses arising from reserved class places that cannot be filled.
Clients who have separately authorised card-on-file payments authorise New You Pilates to charge applicable late-cancellation or no-show fees to their nominated payment method.
Where New You Pilates cancels a session, clients will receive an appropriate replacement session, credit or refund, consistent with applicable consumer law.
Any cancellation charge will be assessed and adjusted where required by law. Special circumstances may be considered at the studio's discretion.
6. Payments, Class Packages and Memberships
Payment is required according to the pricing and booking arrangements disclosed at the time of purchase.
Class Packages
Package prices, session allowances and expiry dates will be displayed before purchase
Packages are for the registered client's personal use and cannot be transferred without studio approval
Unused sessions expire on the disclosed expiry date, subject to applicable consumer rights
Refunds are not provided solely for change of mind, unless otherwise agreed or required by law
Memberships
Membership pricing, billing frequency, minimum terms and cancellation requirements will be disclosed before enrolment
Recurring payments will continue in accordance with the membership agreement until cancelled under its applicable terms
Clients must follow the disclosed cancellation procedure and notice period
Failed payments may result in suspension of bookings or memberships until payment is resolved
Any failed-payment administration fees must be disclosed before enrolment and must be reasonable
Clients will receive reasonable advance notice of proposed membership price increases, with any applicable cancellation rights explained
Membership conditions provided at the time of purchase form part of the client's agreement with New You Pilates.
Refunds
Refunds and remedies will be provided whenever required by Australian Consumer Law. Nothing in these conditions removes your statutory consumer guarantees.
7. Gift Vouchers
Where New You Pilates sells gift vouchers:
Purchased gift vouchers will generally remain valid for at least three years from the date of purchase, unless a lawful exception applies
Applicable expiry dates and conditions will be clearly displayed
Gift vouchers cannot ordinarily be exchanged for cash, except where required by law
Lost or stolen vouchers will be assessed individually, and reasonable proof of purchase may be required
8. In-Home Pilates Sessions
For Pilates sessions conducted at a client's home or other private premises:
Clients must provide a reasonably safe, clean and unobstructed exercise area
The exercise space must have adequate room for movement and equipment
Clients must disclose known hazards that could affect the instructor's or client's safety
Pets and other potential interruptions must be appropriately managed during the session
The instructor may postpone or decline a session if the environment presents an unacceptable safety risk
Clients are responsible for losses or damage directly caused by their negligent or intentional conduct, to the extent permitted by law.
The standard cancellation policy applies to in-home bookings. Any additional travel charges or special cancellation terms will be disclosed before the booking is confirmed.
9. Equipment, Conduct and Damage
Clients must use studio equipment only as instructed.
Clients are expected to:
Follow reasonable safety instructions
Report damaged or malfunctioning equipment immediately
Avoid using equipment beyond their physical capabilities
Respect studio property and other participants
Clients may be held responsible for the reasonable cost of repairing or replacing equipment damaged through intentional misuse or negligent conduct.
To the extent permitted by law, clients agree to compensate New You Pilates for reasonable, directly resulting losses caused by their intentional misconduct, negligence or failure to follow reasonable safety instructions.
This obligation does not apply to losses caused by New You Pilates or its personnel, or where imposing it would be unlawful.
10. Illness and Infectious Conditions
Clients must not attend classes when experiencing a contagious illness or symptoms that could present a risk to others.
Please notify New You Pilates as early as possible if illness prevents your attendance.
The standard cancellation policy applies to illness-related cancellations, subject to applicable law and any reasonable exceptions approved by the studio.
11. Pregnancy and Special Requirements
Pregnant clients, clients recovering from surgery and those managing relevant medical conditions must notify their instructor before participating.
Modified exercises or medical clearance may be required where appropriate.
New You Pilates may recommend an alternative class or decline participation where reasonably necessary for safety.
Pilates instruction is not a substitute for medical diagnosis or treatment.
12. Children and Participants Under 18
Clients under 18 must have approval from a parent or legal guardian before participating.
A parent or legal guardian must complete the relevant registration, health information and agreement on behalf of the minor.
New You Pilates may impose additional age or participation restrictions where reasonably necessary for safety.
13. Photography and Video Consent
New You Pilates may occasionally photograph or film classes for promotional purposes.
Identifiable images or recordings of clients will not be used in advertising, on the website or on social media without appropriate consent.
Participation in promotional photography is entirely optional and is not a condition of receiving Pilates services.
14. Privacy and Personal Information
New You Pilates collects personal information necessary for bookings, client communication, payment administration and the safe provision of Pilates services.
This may include relevant health and medical information.
By separately consenting through the registration or health screening process, you authorise New You Pilates to collect and use relevant health information for these purposes.
Personal and health information will be handled in accordance with applicable Australian privacy laws and our Privacy Policy.
Marketing communications requiring consent will be managed separately from mandatory client registration.
15. Emergency Medical Assistance
In a medical emergency, New You Pilates may contact emergency services and provide information reasonably necessary to assist with your care, as permitted by law.
Clients acknowledge that ambulance or medical expenses may be payable by them, subject to any applicable legal obligations.
16. Personal Belongings
Clients are responsible for taking reasonable care of their personal belongings.
New You Pilates is not responsible for loss, theft or damage except where responsibility arises under applicable law.
17. Changes to Classes and Services
New You Pilates may make reasonable changes to class schedules, instructors, equipment and services for operational or safety reasons.
Affected clients will be informed where reasonably practicable.
Where a material change prevents a client from receiving a purchased service, an appropriate alternative or remedy will be provided in accordance with applicable law.
18. Changes to Terms and Conditions
New You Pilates may update these Terms and Conditions from time to time.
Updated terms will be published on our website, and clients will receive notice of material changes affecting ongoing agreements.
Changes will not retrospectively remove existing contractual or statutory rights. Where required, clients will be asked to accept revised terms.
